10/27/11 Killbuck man gets SRCCC for trying to climb in girl's window

                        
A Killbuck man who attempted to climb into the residence of a 17-year-old girl with whom he has a child was sentenced Thursday Oct. 27 on an attempted burglary charge. Tony L. Underwood, 20, 487 Moose Drive, was sentenced by Holmes County Common Pleas Judge Robert D. Rinfret to up to six months at the Stark Regional Community Corrections Center. The charge stems from June 27, when Underwood attempted to enter the home of a 17-year-old girl he had a relationship with. According to court records, the girl’s parents caught Underwood on the roof while he was apparently attempting to enter the girl’s room. The girl’s parents had previously told Underwood he was not allowed to see her. The girl was not home at the time. Rinfret told Underwood that attempting to break in to the home could have resulted in a tragic outcome. “You’re lucky you haven’t been shot,” Rinfret said. “How many people have guns in this county, know what I’m saying?” In exchange for Underwood’s guilty plea, the attempted burglary charge was reduced from a fourth-degree felony to a fifth-degree felony. Rinfret further sentenced Underwood to 180 days in jail, to be suspended after Underwood completes treatment at SRCCC.
