11/10/11 Millersburg man facing prison time after pleading to burglary, domestic violence

                        
SUMMARY: Defendant's attorney says client wants to tell his side of the story A Millersburg man is facing up to three and a half years incarceration after pleading guilty to forcing his way into a residence and striking his girlfriend. Terry L. Reed, 54, 4849 Township Road 339, pleaded in Holmes County Common Pleas Court to one count of burglary, a third-degree felony, and domestic violence, a first-degree misdemeanor. The charges stem from June 16, when Reed forcibly entered a Crawford Street residence in Millersburg and struck his girlfriend. According to Assistant Prosecuting Attorney Sean Warner, Reed broke down the door of the Crawford Street residence, where his girlfriend was inside with another man. Warner said Reed attacked his girlfriend, striking her and pulling out a clump of hair. The girlfriend was treated at Pomerene Hospital after the assault. Reed was later picked up after the assault by Millersburg Police while walking down the street, Warner said. According to Reed’s attorney, Jeff Kellogg, Reed admits to breaking down the door but says there are two sides to the domestic violence charge. “I think he can say (the police) report is correct as far as the felony,” Kellogg said. “There’s a lot of interpretation as to what occurred (with the domestic violence charge). He wants to explain his side, and he will during the presentence process.” The owner of the Crawford Street residence reported $595 in damages to the door, according to court records. Common Pleas Judge Robert D. Rinfret ordered a presentence investigation and scheduled sentencing for Jan. 12. The burglary charge against Reed carries up to 36 months in prison. The domestic violence charge carries up to 180 days in jail.
