4/27/11 Killbuck couple sentenced on trafficking, endangering childre charges

                        
SUMMARY: Residential treatment considered for both codefendants A Killbuck couple were sentenced Wednesday April 27 on charges of drug trafficking and child endangering. Terry D. Holcomb II, 33, and Hollie M. Kelley, 32, both of 10190 Township Road 71, were sentenced by Holmes County Common Pleas Judge Robert D. Rinfret for their individual roles in marijuana sales that occurred in April - June of last year. According to court documents, Holcomb and Kelly made three marijuana sales totaling $230 to a confidential informant working with the Medway Drug Enforcement Agency. A juvenile was present during at least one of the sales, which were conducted at the Township Road 71 property. Holcomb previously pleaded to one count of trafficking in marijuana. Kelley previously pleaded to trafficking in marijuana and child endangering. Attorneys representing Holcomb and Kelley asked for residential treatment at Stark Regional Community Correction Center. Holcomb has a prior criminal record, most notably a string of breaking and entering offenses that stretched across three counties in 1999. He was sentenced to 30 months in prison on those charges. Holcomb’s attorney, David Knowlton, said his client’s past criminal history is the result of drug use and treatment is an option that has never been made available to him. “This is an opportunity to get my client to a place he’s never been before,” Knowlton said. “He’s never had a chance at substance abuse treatment. Had he gotten it before he might” not be here, Knowlton said. Rinfret sent Kelley to SRCCC but felt Holcomb could wait. “I’ll consider SRCCC after a certain time frame,” Rinfret said. “I’m going to give you a chance to prove yourself, but you’re going to do some time first.” Rinfret sentenced Holcomb to 12 months in prison and pay back the $230 in buy money from the marijuana sales. Kelley was sentenced to up to six months at SRCCC, and Rinfret suspended both co-defendants’ drivers licenses for five years. Rinfret said he will consider sending Holcomb to SRCCC after reviewing his behavior while incarcerated.
