5/17/11 Lakeville man sentenced on meth cooking charges

                        
SUMMARY: Gets three years in prison, $5,000 fine A Lakeville man was sentenced Tuesday May 17 on methamphetamine cooking and possession charges. Dannel H. Weaver, 36, 14060 state Route 39, was sentenced by Holmes County Common Pleas Court Judge Robert D. Rinfret to three years in prison and a $5,000 fine on charges of illegal assembly or possession of chemicals for the manufacture of methamphetamine, a third degree felony, and possession of methamphetamine, a fifth-degree felony. The illegal assembly charge carried a mandatory two year sentence. The charges against Weaver stem from a search warrant executed March 31 at the state Route 83 residence. According to Prosecuting Attorney Steve Knowling, Holmes County Sheriff’s deputies recovered chemicals used in the making of meth as well as after products of cooking meth. Weaver apparently was using an older method to cook meth that uses anhydrous amonia, and a propane tank modified to hold amonia was found at the residence. Knowling said Weaver “had been living there the last two weeks...and the landlord said those items were not there before he moved in.” A quantity of meth was also recovered from the residence, Knowling said. Weaver said he started using meth “six or seven years ago” but “there were a couple of years I did not use it.” The three year sentence was arrived at in a joint sentencing recommendation between Knowling and Weaer’s attorney, Jeff Kellogg. Weaver pleaded to the charges Tuesday with the understanding the case would proceed immediately to sentencing. Rinfret further suspended Weaver’s driver’s license for five years.
