6/15/11 Two plead guilty in fake cocaine sale

                        
SUMMARY: State to seek forfeiture of defendant's car A man and woman who were caught with marijuana and paraphernalia in a traffic stop that followed a drug buy pleaded to charges Wednesday in Holmes County Common Pleas Court. Phillip A. Farley, 32, and Angela R. Smith, 33, both of 3317 Township Road 629, Loudonville, pleaded to charges that stem from a string of drug sales and an April 11 traffic stop. According to Prosecuting Attorney Steve Knowling, the traffic stop was made by Holmes County Sheriff’s deputies April 11 a short while after a confidential informant working with Holmes County Sheriff’s deputies purchased a substance Farley presented as cocaine. Farley and Smith were stopped following the buy driving a 2002 Dodge Intrepid licensed to Smith. A search of the car turned up marijuana, rolling papers, scales and baggies, Knowling said. The cocaine turned out to be counterfeit, Knowling said. Deputies had previously purchased marijuana from Farley April 8. The buys took place in a parking lot in Killbuck. Farley pleaded guilty Wednesday to trafficking in marijuana within the vicinity of a school, trafficking in cocaine within the vicinity of a school and trafficking in marijuana. Smith pleaded guilty to permitting drug abuse. Farley faces up to a total of five years in prison and Smith faces up to 12 months in prison. The state is further seeking forfeiture of Smith’s car. Common Pleas Court Judge Robert D. Rinfret scheduled Farley’s sentencing for Aug. 17 and Smith’s sentencing for Aug. 24.
