7/20/11 Mother, son sentenced on drug charges

                        
SUMMARY: Judge calls charges against mother "an isolated incident" A Fredericksburg woman who said she was deceived into selling her medication was sentenced July 20 to probation. Brenda A. May, 50, 9272 County Road 192, was sentenced to three years probation by Holmes County Common Pleas Court Judge Robert D. Rinfret on one count of trafficking in a schedule IV drug within the vicinity of a school. Her son, Joshua K. May, 28, also of 9272 County Road 192, was sentenced also Thursday to 18 months in prison on charges of trafficking in marijuana in the vicinity of a school, trafficking in a schedule IV drug in the vicinity of a school and trafficking in cocaine in the vicinity of a school. The charges against Brenda May stem from Jan. 14 and Jan. 16, when she sold Alprazolam to a confidential informant working with the Holmes County Sheriff?s office. The sales were made in a parking lot in Holmesville. Alprazolam is an anti-anxiety drug. Brenda May?s attorney, Christina Smith, said the informant told Brenda he was out of his prescribed Alprazolam and needed more. Speaking before Rinfret, Brenda May said she knows it was wrong to sell her medication. ?He said he was on the same thing. I didn?t learn why (he said that) until later,? Brenda May said. ?I don?t go looking for trouble.? The charges against Joshua May stem from controlled buys between Nov. 23 and Jan. 18 to the informant. Rinfret said he sentenced Joshua May to prison because May has previously served a prison sentence and has ?failed to acknowledge a pattern of drug abuse (and) fails to show genuine remorse?. Rinfret said Brenda May, on the other hand, has no prior criminal history besides a violation filed by the dog warden. ?This is unusual for me,? Rinfret said. ?Of the defendants I?ve seen, your record is one of the best. I believe this is an isolated incident.? Rinfret further ordered Joshua May to pay $330 restitution for money used in the controlled buys by the sheriff?s office. Brenda May was similarly ordered to pay back the $40 used in the Jan. 14 and Jan. 16 drug transactions.
