8/18/11 Millersburg man gets jail for marijuana trafficking

                        
SUMMARY: Tells judge he is still sometimes tempted to use marijuana A Millersburg man went to jail Thursday Aug. 18 on trafficking in marijuana charges. David Custer, 21, 283 Grant St., was sentenced by Holmes County Common Pleas Judge Robert D. Rinfret to 180 days in jail on three counts of trafficking in marijuana. The charges stem from September 2010 and January 2011. According to Assistant Prosecuting Attorney Sean Warner, a confidential informant working with the Holmes County Sheriff’s office purchased marijuana from Custer Sept. 27, Jan. 3 and Jan. 4. According to Custer’s attorney, Jeff Kellogg, the informant was a friend of Custer’s, and Custer served more as a go-between than a drug dealer. “The confidential informant requested he get marijuana for him,” Kellogg said. “These weren’t for profit, (Custer) didn’t make any money on these transactions.” Since pleading to the charges in June, Custer has maintained employment and has turned up negative when tested for drugs by probation authorities. Speaking before Rinfret, Custer said he is sometimes tempted to use marijuana. “I now seek a higher standard of living,” Custer said. “Though there are days when I want to smoke weed, I don’t want to throw away this chance for a couple hours of fun.” Rinfret further ordered Custer to pay a $1,000 fine and pay back the $150 used by the sheriff’s office to buy the marijuana. Custer will also be required to complete the New Directions program through the American Community Corrections Institute and pay all costs associated with the program.
