8/24/11 Millersburg man who sold stolen gun gets three years

                        
A Millersburg man who claimed he stole a gun to commit suicide but later sold it was sentenced Wednesday Aug. 24 in Holmes County Common Pleas Court. Andrew L. Milner, 27, 6514 Township Road 350, was sentenced by Common Pleas Judge Robert D. Rinfret to three years in prison on one count of grand theft of a firearm. The charge stems from April 26, when Milner stole a handgun from the mobile home of an acquaintance. Milner was in possession of the firearm May 16, when he called his wife from a cabin and said he was going to kill himself. A Holmes County Sheriff’s deputy talked Milner down and took him and the weapon into custody. At the time, the gun was not listed as stolen. It was later returned to Milner, who sold it. Rinfret asked Milner why he didn’t return the handgun to the owner. Milner said he “didn’t know what to do with it” and was afraid of having it handy should he experience suicidal tendencies again. Milner’s attorney, Thomas White, asked the court to consider residential treatment. White said residential treatment would be beneficial to Milner and society, as it would address Milner’s drug problem as well as his mental health issues. “I think you and I have seen too many cases where people kill themselves in front of their children,” White, speaking to Rinfret, said. Rinfret said Milner should have returned the gun when he had the chance. “Instead of giving it back to the (owner, Milner) sold it,” Rinfret said. “That really bothers me.” Rinfret further ordered Milner pay restitution of $160 to the owner of the firearm. Grand theft of a firearm is a third-degree felony and carries up to five years in prison.
