9/23/13 Pennsylvania man charged in July traffic death

                        
SUMMARY: Faces charges of vehicular homicide, vehicular manslaughter in death of five year old boy A Pennsylvania man pleaded not guilty Friday Sept. 20 to charges that allege he caused the death of a five year old boy in a Berlin traffic accident. David J. King, 24, 1114 Reservoir Road, New Holland, is charged in Holmes County Municipal Court with vehicular homicide, a first-degree misdemeanor, and vehicular manslaughter, a second-degree misdemeanor. The charges stem from a July 13 accident that claimed the life of Sheldon R. Horst, 5, of Shelby. According to Ohio State Highway Patrol, Wooster Post, reports, the accident occurred at approximately 5:55 a.m. when King was traveling on State Route 39 in a 2002 Chevy truck near County Road 135. King traveled left of center and struck an eastbound 2003 GMC Savana driven by driven by Nelson Z. Horst, 40, state Route 598, Shelby. The Savana overturned on its right side on the south edge of the roadway. King continued westbound and drove off the south side of the roadway, striking a fence. Sheldon was pronounced dead at the scene. Sheldon was in a booster seat at the time of the accident, according to OSP reports. The van contained 12 passengers, including Sheldon and Nelson Horst. The surviving occupants of the van were transported to area hospitals with non-life threatening injuries. The OSP carried out an extensive reconstruction of the accident prior to charges being filed. Municipal Court Judge Jane Irving scheduled the case for a Oct. 22 pre-trial conference. Davis faces up to 180 days in jail and a $1,000 fine on the most serious charge.
