SUMMARY: Gets nine months of marijuana trafficking charge
A Shreve man said he skipped out on court-ordered appointments with probation while awaiting sentencing on a drug trafficking charge to be with his family.
Richard S. Lyons, 26, 11390 Township Road 506, was sentenced Thursday Dec. 8 by Holmes County Common Pleas Judge Robert D. Rinfret to nine months in prison on one count of trafficking in marijuana, a fifth-degree felony. Rinfret said Lyons received the prison sentence because of his inability to follow through with orders while under community control sanctions.
The charge stems from Feb. 8, when Lyons sold marijuana for $100 to a confidential informant working with the Holmes County Sheriffs narcotics unit. A codefendant, Bridgette Kimbrell, 20, Millersburg, was previously sentenced to jail time and probation.
Rinfret said the courts have tried everything else with Lyons and he needs to see the inside of a prison cell. While Lyons was on bond awaiting sentencing, he skipped two meetings with probation authorities. After a warrant was issued to bring Lyons in, probation were unable to locate Lyons at the address he provided.
Lyons was located at another residence and tested positive for marijuana in a drug screen, another violation of his bond.
Lyons said he was spending the time he should have been reporting to probation with his family.
I just wanted to see my kids, Lyons, when questioned by Rinfret, said.
Rinfret further ordered Lyons to pay back the $100 used to facilitate the drug buy and suspended Lyons drivers license for three years.
